Terms & Conditions

Balfour Founders Club Membership · Effective date: 16 July 2026 · Version 1.0

These terms govern your membership of the Balfour Founders Club and your use of the Founders Club app. Please read them carefully and keep a copy for your records.

1. About these terms and who we are

1. The club. The Balfour Founders Club (the "club") is the customer loyalty programme operated by Hush Heath LLP, trading as Balfour Winery ("Balfour", "we", "us", "our"). Your membership and the app remain the property of Balfour, which may decline, issue or withdraw the app, an account, or any benefit, and may amend, suspend or terminate the club, as set out in these Terms. 2. These terms. These terms and conditions (the "Terms"), together with our Privacy Policy, form a legally binding agreement between you (the "member", "you") and Balfour. By creating an account or joining the club you accept these Terms. 3. Other documents. Individual rewards, offers and partner promotions may carry their own additional terms shown in the app. Where they do, those additional terms apply alongside these Terms. If there is a conflict, the specific reward's terms apply to that reward. 4. The app. The club is delivered through the Balfour Founders Club app (the "App"). Your use of the App is also subject to any app-store terms and to these Terms.

2. Eligibility and membership

1. Who can join. Membership is free and open to individuals aged 18 or over who hold a valid email address. Some rewards include alcoholic drinks; these are available only to members aged 18 or over and are subject to our right to refuse service in line with licensing law. 2. One account per person. Each member may hold only one account, and the account is personal to you — it may not be transferred, shared or operated on behalf of a business. 3. Where the app can be used. Membership can be used only at participating Balfour venues, shown in the app. 4. Signing up. Joining requires only an email address. You may optionally add your name, date of birth and a profile photo at any time from Account Settings — date of birth is used solely to identify your birthday reward window. You agree to keep your details accurate and up to date. 5. Your account and security. You are responsible for keeping your device and sign-in secure and for activity that takes place under your account. Tell us promptly if you believe your account has been accessed without your permission.

3. Your membership card and QR code

1. Your card. The App shows a digital Founders Club card with a scannable QR code. It may also be added to Apple Wallet or Google Wallet. 2. Scanning at venue. Present your QR code to a member of staff, or scan it yourself where self-service scanning is available, so it can be read by the venue's point-of-sale system. The code refreshes periodically for security; the underlying membership number shown beneath it stays constant. 3. Lost or stolen devices. If your device is lost or stolen, sign in to the App on another device or contact us so we can help secure your account. We are not liable for any reward redeemed by someone else using a device that was lost, stolen or left unlocked.

4. Rewards and redemption

1. The reward catalogue. Available rewards are shown in the App and may change at any time at our discretion. Rewards are organised into categories — Core (always-on membership benefits), Seasonal (time-limited offers) and Partner (offers fulfilled by a third party) — and each carries its own description, eligibility and any additional terms in the App. 2. Activating a reward. Most rewards must be activated in the App before they can be redeemed. Once activated, a reward is valid only for the period shown in the App at the time of activation. Only activate a reward when you are at the venue and ready to order — an activated reward that goes unused within its window is treated as used and cannot be reactivated. 3. Partner rewards. Partner rewards are informational: show the reward's page in the App to the partner venue to redeem. Partner offers are provided by the third party named in the App and are subject to that partner's own availability and terms; Balfour is not responsible for how a partner fulfils its offer. 4. Rewards issued by our staff. Some rewards may be applied directly by Balfour staff rather than activated by you — these are shown as read-only in the App. 5. General conditions. Rewards are personal to you, cannot be transferred, sold or exchanged for cash, are subject to availability, and may be withdrawn, replaced or amended by us at any time. The birthday reward requires a verified date of birth on your account and is available during the period shown in the App around your birthday; we may require proof of age.

5. Fair use

The club is intended to reward genuine visits. You agree not to create more than one account, activate or redeem rewards other than through your own genuine visits, share your QR code for someone else to redeem a reward, use automated means against the App, or provide false information. Where we reasonably believe conduct of this kind has occurred, we may withhold or reverse a reward, suspend or close your account, and decline future membership.

6. Suspension, closure and leaving the club

1. Leaving. You may leave the club at any time by deleting your account in the App (Account Settings) or by contacting us. When you leave, any unredeemed reward is forfeited. 2. Our right to suspend or close. We may suspend or close your account, or withdraw a reward, if you breach these Terms, if required by law, or for other good reason on reasonable notice.

7. Changes to the club and these terms

We may change the reward catalogue, participating venues, and these Terms, to reflect changes in our business or for other good reason. Where changes are material and to your disadvantage, we will give reasonable notice through the App before the change takes effect. Continued use of the App after a change takes effect constitutes acceptance of the updated Terms. We may also suspend or withdraw the club as a whole, giving reasonable notice where practicable.

8. Your privacy and data

We process your personal data to operate the club, including your email address and any name, date of birth or photo you choose to add, and a record of rewards you activate at participating venues. How we use your data is described in our Privacy Policy.

9. Liability

1. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded. 2. Subject to the above, we are not liable for the unavailability of any reward, partner offer or the App, or for any indirect or consequential loss. The club and its rewards are provided on a reasonable-efforts basis. 3. These Terms do not affect your statutory rights as a consumer under the law of England and Wales.

10. General

1. Whole agreement. These Terms, our Privacy Policy and any specific reward terms shown in the App are the whole agreement between us regarding the club. 2. Severance. If any provision is found to be unlawful or unenforceable, the remaining provisions continue in force. 3. Governing law. These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
